OSIM International Pte. Ltd. (Co. Reg. No. 198304191N) of 65 Ubi Avenue 1 OSIM Headquarters, Singapore 408939 ("OSIM" or “we” or “us” or “our”), is committed to protecting your personal data.

The purpose of Privacy Notice (“Notice”) is to inform you of how we manage Personal Data and to set out the type of Personal Data we gather about you, what we do with it, the safeguards we have in place to protect it, and how you can control our use of it.

1. Scope

In the event of any inconsistency between different versions of this Notice, the English version shall prevail.

This Notice supplements but does not supersede nor replace any other consents you may have previously provided to OSIM in respect of your Personal Data and your consents herein are additional to any rights which we may have at law to collect, use or disclose your Personal Data.

2. Meaning of “Personal Data”

In this Notice, “Personal Data” refers to any data, whether true or not, about an individual who can be identified (a) from that data; or (b) from that data and other information to which we have or are likely to have access, including data in our records as may be updated from time to time.

3. Meaning of “Electronic Platforms”

Whenever we have used “Electronic Platforms” in this Notice, it means our website, online store, and mobile applications.

4. Provision of Data

If you provide us with any Personal Data relating to a third party (e.g. information of your spouse, children, parents, and/or employees), by submitting such information to us, you represent to us that you have obtained the consent of the third party to provide us with their Personal Data for the respective purposes.

You should ensure that all Personal Data submitted to us is complete, accurate, true and correct. Failure on your part to do so may result in our inability to provide you with the services you have requested

5. Collection of Your Personal Data

OSIM may collect your Personal Data in the following ways:

(a) Customer Service Interactions
when you interact with our customer service team or our marketing representatives, for example, via telephone calls, letters, face-to-face meetings and emails;

(b) Account and Profile Information
when you register for an account, create or modify your profile, set preferences, sign-up for or make purchases through our online store or mobile applications;

(c) Using Our Products And Services
when you use some of our products and services, for example, our mobile apps, including establishing any online accounts with us;

(d) Request for Us to Contact You, Subscription to Mailing List
when you request that we contact you, or that you be included in an email or other mailing list;

(e) Feedback, Surveys and Market Research
we collect the personal data that you submit to us when you provide feedback to us, respond to our surveys, or participate in market research;

(f) Promotions and Requests for Additional Personal Data
when you respond to our promotions, lucky draws, initiatives or to any request for additional Personal Data;

(g) Third Parties
we may receive your personal data:

• when we receive references from business partners and third parties, for example, where you have been referred by them;

• when we receive contact data, financial data and transaction data from providers of technical, payment and delivery services; or

• when you integrate or link a third-party service with our Electronic Platforms, e.g. if you create an account or log into the Electronic Platforms using your Facebook credentials, we receive your personal data as permitted by your Facebook profile settings in order to authenticate you;

(h) OSIM Global Network
we may receive your personal data from the other companies in our corporate group (such as our subsidiaries), or our franchisees, distributors or other authorised resellers of our products and/or services (“OSIM Global Network”); and

(i) when you submit your Personal Data to us for any other reasons.

6. Purposes of Collection, Use, and Disclosure of Your Personal Data

OSIM, including its related corporations, business units, and the OSIM Global Network (collectively, the “OSIM Group Members”) as well as their respective representatives and/or agents, may collect, use, disclose and share amongst themselves your Personal Data, and disclose such Personal Data to the OSIM Group Members' authorised service providers and relevant third parties for the following purposes (“Purposes”):

a. Direct Marketing (If You Opt-In)
(if you have indicated that you wish to receive marketing communications)
communicating to you advertisements involving details of the OSIM Group Member’s products and services, special offers and rewards, either to customers generally, or which the OSIM Group Member(s) have identified may be of interest to you (including but not limited to upselling, cross selling and online marketing);

b. Customise Your Customer Experience
(if you have indicated that you wish to receive marketing communications)
providing you with personalised marketing communications, advertisements and promotional offers from OSIM Group Members, e.g. by providing you with tailored product recommendations based on your past purchases or based on your responses to optional questions on our mobile applications or customer surveys;

c. Loyalty and Reward Programmes
providing loyalty and reward programmes from the OSIM Group Member(s);

d. Provide and Maintain Services
To allow the OSIM Group Member(s) to provide you access to their services and any relevant customer support;

e. Transfer of your Personal Data to external processers
To transfer your personal data to OSIM’s hosting servers whether located in Singapore, or elsewhere, subject to compliance with the applicable requirements under Singapore’s Personal Data Protection Act 2012 and/or any other applicable law;

f. Internal Policies, Administration and Business Operations
managing the administrative and business operations of OSIM Group Members and complying with internal policies and procedures;

g. Business Asset Transactions
Facilitating business asset transactions (which may extend to any mergers, acquisitions or asset sales) involving any of the OSIM Group Members;

h. Complaint Resolution, Requests and Enquiries
For resolving complaints and handling requests and enquiries;

i. Crime Prevention and Managing of Commercial Risks
preventing, detecting and investigating crime and analysing and managing commercial risks and conducting investigations relating to disputes, billing or fraud;

j. Legal Purposes
for legal purposes, including but not limited to obtaining legal advice and dispute resolution, and meeting or complying with any applicable rules, laws, regulations, codes of practice or guidelines issued by any legal or regulatory bodies which are binding on OSIM or the OSIM Group Members (including responding to regulatory complaints, disclosing to regulatory bodies and conducting audit checks, due diligence and investigations);

k. Phone Calls and Customer-Facing Interactions
monitoring or recording phone calls and customer-facing interactions for quality assurance, employee training and performance evaluation and identity verification purposes;

l. Social Sharing Features
Our Electronic Platforms may integrate with social sharing features and other related tools which let you share actions you take on our Electronic Platforms or Personal Data collected by your Electronic Platforms with other apps, sites, or media, and vice versa. Your use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the social sharing service. Please refer to the privacy policies of those social sharing services for more information about how they handle the data you provide to or share through them.

Our Electronic Platforms may also have social media tools or features that allow you to sign up for an account with OSIM by giving us permission to retrieve and collect your Personal Data (such as your email address) from other apps, sites, or social media platforms. By choosing to use such tools or features, you consent to us collecting, using and disclosing your Personal Data for the purposes of establishing your new account with OSIM; and

m. Market Research
conducting market research to enable OSIM to understand and determine customer preferences and demographics to develop special offers and marketing programmes in relation to our products and services, and to improve our service delivery and personalise our customers’ experience at our touchpoints; and

n. Reasonably Related Purposes
Any purposes reasonably related to any of the purposes stated above.

In relation to particular products and services or in your interactions with us, we may also have specifically notified you of other purposes for which we collect, use or disclose your Personal Data. If so, we will collect, use and disclose your Personal Data for these additional purposes as well, unless we have specifically notified you otherwise.

7. Security Arrangements

OSIM will implement reasonable security arrangements to prevent unauthorized access, collection, use, disclosure, modification to your Personal Data.

8. Storage and Transfer

OSIM will store the Personal Data collected from you in our servers located in Singapore.

In the event that OSIM may need to transfer your Personal Data out of Singapore, we will take steps to ensure that the recipient organisation is bound by legally enforceable obligations to accord the same standard of protection to the transferred Personal Data as it would enjoy under Singapore data protection laws.

9. Information Sharing and Disclosure

OSIM will take reasonable steps to protect your Personal Data against unauthorised disclosure. Information provided by you is not sold to other parties for any commercial purposes.

10. Notwithstanding the above, subject to the provisions of any applicable law, your Personal Data may be disclosed, for any of the purposes listed above in Section 6 (Purposes of Collection, Use, and Disclosure of Your Personal Data) of this Notice (where applicable), to the following:

a. Related Corporations
OSIM’s related corporations, business units and employees to provide content, products and services to you, address your questions and requests in relation to your customer accounts, subscription and billing or order arrangements with us as well as our services, to activate, deactivate, install, maintain and operate our systems and/or services;  

b. Insurance and Consultancy Services
companies providing services relating to insurance and consultancy to OSIM;

c. External Service Providers
agents, contractors or third party service providers who provide operational services to OSIM, such as courier services, information technology services, telecommunications, payment processing services, printing, billing, payroll, processing, technical services, training, market research, call centre, security services, customer relationship management services, marketing and sales assistance, etc.

d. Business Partners, Investors
any business partner, investor, assignee or transferee (actual or prospective) to facilitate business asset transactions (which may extend to any merger, acquisition or asset sale) involving any of the OSIM Group Members;

e. OSIM Global Network
our franchisees, distributors and other authorised resellers of our products and/or services, and in particular:

(1) OSIM’s Authorised Resellers in USA Region 

Where you are resident in the United States of America, OSIM may transfer your Personal Data to the United States of America and share your Personal Data with any of OSIM’s franchisees, distributors and other authorised resellers of OSIM products and/or services in the United States of America;

(2) OSIM’s Authorised Resellers in Canada Region

Where you are resident in Canada, OSIM may transfer your Personal Data to Canada and share your Personal Data with any of OSIM’s franchisees, distributors and other authorised resellers of OSIM products and/or services in Canada;  

f. Professional Advisors
our professional advisers such as auditors and lawyers;

g. Regulatory Authorities, Law Enforcement
relevant government regulators, statutory boards or authorities or law enforcement agencies to comply with any laws, rules, guidelines and regulations or schemes imposed by any governmental authority;

h. Social Sharing Features
the third party apps, sites or media that you permit us to share your data with; and

i. Parties Authorised By You
any other party to whom you authorise us to disclose your Personal Data to.

11. Children

We do not knowingly collect Personal Data from children under 13, or equivalent minimum age depending on jurisdiction. If you become aware that a child has provided us with Personal Data without parental consent, please contact us at dpo@OSIM.com.sg.

If we learn that we have collected the personal information of a child under 13, or equivalent minimum age depending on jurisdiction, without parental consent, we will take steps to delete the information as soon as possible.

12. Third Party Websites or Advertising

This Notice does not apply to services offered by other companies or individuals, including websites that may include OSIM products or services, or other sites linked from our Electronic Platforms. Our Notice does not cover the information practices of other companies and organizations who advertise our products and services.

If you have provided your Singapore telephone number(s), OSIM may contact you using such Singapore telephone number(s) (including via voice calls, SMS, fax or other means) with information about our products and services (including discounts and special offers).

14. Withdrawal, Access and Correction

You may withdraw your consent to any of the aforementioned purposes at any time by contacting us at:

However, OSIM may be unable to provide you with access to certain services or certain smart device features of your products as a result of your withdrawal of consent to such collection, use and/or disclosure of your Personal Data.

15. Retention

OSIM will retain your Personal Data for the duration of time to carry out the purposes for which your personal data was collected, for the other purposes set out in this Notice, for business purposes and as required by relevant laws.

16. Governing Law and Jurisdiction

This Notice shall be governed by and construed in accordance with the laws of Singapore. The parties irrevocably agree to submit to the non-exclusive jurisdiction of the courts of Singapore as regards any claim or matter arising in relation to this Notice. The Contracts (Rights of Third Parties) Act (Cap. 53B) of Singapore shall not apply to the Notice.

17. Updates to Notice

OSIM reserves the right, at any time and without notice, to add to, change, update or modify this Notice, simply by notifying you of such change, update or modification by posting notification of such change, update or modification on our website or notifying you via other suitable methods. Any such change, update or modification will be effective as stated in the notice of such change, update or modification.
